The Town of Oro Valley is committed to maintaining your online privacy and the confidentiality of personal information you may provide while interacting with us online. This policy serves to describe the Town of Oro Valley’s privacy practices regarding the collection and use of information from visitors to the Town’s official websites:

Any personal information that is collected on these websites will be managed in accordance with the Arizona Public Records Law and the Freedom of Information Act. Collection and use of Information

The Town of Oro Valley collects the following site information during browsing sessions:

  • Google Analytics
    The Town of Oro Valley uses data from Google’s interest-based advertising or 3rd-party audience data (such as age, gender and interests) with Google Analytics. This kind of information is collected automatically unless users opt out. Using Ads Settings, visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads. You may also view Google Analytics' currently available opt-outs for the web.

  • Anonymous Information
    This is information collected that does not identify specific individuals by name and is automatically transmitted by your browser when visiting Town websites. Examples of the types of anonymous information we collect includes: URLs or addresses of the web pages you visit while at our Town websites, the IP address assigned to your computer (or as generated by your Internet service provider), information about the type of browser you are using and its configuration, and other technical metrics related to your browser connection to our Town websites. This type of information is used for statistical purposes, to help us improve our website content and navigation. It is collected for ALL Town website visitors automatically.

  • Personally Identifiable Information
    This is information that you choose to supply in order for us to provide an online service, or in response to a survey or question. This may include items such as: your name, home address, email address, telephone number or credit/debit card information. The Town of Oro Valley attempts only to collect the minimal amount of personal information needed in order to provide the service being requested. These online requests for personal information are no different than the types of questions that you would be asked if you were to visit a Town facility, or use the telephone, to obtain needed services or information from the Town. It is your option to supply us with this information, however in some cases it is required to complete certain online service requests. Alternative methods of obtaining services are offered, such as telephone and walk-in services, and you may contact the appropriate department to receive information on such alternatives.

Subscription Email Services

The Town of Oro Valley offers many “subscription-based” email services, where visitors can elect to sign up to receive periodic email notifications regarding items such as Town news and events, requests for bids for goods and services and job postings (to name a few). To offer this service we must collect your email address information and store it. This information is only used for the purpose of distributing email notices that you have specifically subscribed to. By agreeing to use this service, you are granting the Town of Oro Valley permission to send you periodic emails about those topics for which you have registered. The Town will not add you to any email lists that you have not specifically signed up for through our registration process. The Town of Oro Valley does not buy, sell, trade or rent emailing lists with, for or to third parties. Visitors are free to “un-subscribe” from any email list they may be registered to by following the instructions distributed with every email sent by this service.

Information Provided by Minors

Except for information provided on the Town of Oro Valley Library website, no applications, services or surveys on the Town’s websites seek to determine or verify the age of site visitors. Consequently, visitors should be aware that the collection of personal information requested from or volunteered by minors online or by email will be treated in the same manner as information given by an adult and may be subject to public access as prescribed by applicable laws. We advise children (minors) to get permission from their parents or legal guardians before providing any information online.

Non-Town Links from the Town Websites

The Town of Oro Valley websites contain links to other non-Town (external) websites. Links to other websites do not constitute an endorsement by the Town of Oro Valley. Such external websites contain information and services that have been created independently of the Town of Oro Valley websites and are only provided as a convenience for our site visitors who may need additional information that we do not control, or otherwise cannot provide. The Town of Oro Valley does not endorse, approve, certify or control these external websites, nor any of the information and data contained on those websites. The Town of Oro Valley cannot guarantee the privacy of your personal information while accessing those websites. The Town encourages visitors to check the privacy policies of all external websites visited, and to be cautious about providing personal information while on these sites without first obtaining a clear understanding of how such information will be used. Many non-Town sites may or may not be subject to Public Records laws and other provisions of state or federal law.

File Modification

If permitted to do so, you may download material on a Town of Oro Valley website for personal, non-commercial use. The Town of Oro Valley will not be held liable concerning any downloaded files and for any effect the downloaded files has on your computer or software. The download, maintenance and use of any files are the responsibility of the visitor. It is your responsibility to check the information for accuracy and to check the website regularly for deleted or changed files.

This means that you may only view or download materials from this site for your own personal, non-commercial and not-for-profit purposes, and you must keep all copyrighted and other proprietary notices attached to the downloaded material.

The “mirroring” or modification of content from this site on any other website or networked computer environment is similarly prohibited. Linking directly to Town websites is permitted and a preferable alternative for sharing information in order to preserve the integrity of the original content.

Members of the public are prohibited from creating works or materials that use the Town of Oro Valley seal and/or the Town’s “OV” logo without written consent from the Town. This includes, without limitation, icons, link buttons, wallpaper, desktop themes, automobile windshield graphics, adhesive stickers, hats, t-shirts, postcards, greeting cards, coffee mugs, business cards and other unlicensed merchandise. Social Media Terms of Use

Town of Oro Valley social media platforms strive to be content neutral and are not intended as public forums; the Town is disseminating information. Shares, Likes and Follows by any Town of Oro Valley account are not endorsements. The Town’s social media sites are not monitored 24/7. Service requests and resident concerns must be directed to Ask Oro Valley at: http://ask.orovalleyaz.gov or 520-229-4711.

 

The Town of Oro Valley reserves the right to remove any user-generated content that includes:

  • Language that is deemed objectionable or inappropriate for children
  • Profane or threatening language
  • Obscene sexual content
  • Content that promotes, fosters, or perpetuates discrimination on the basis of race, creed, color, age, religion, gender, marital status, status with regard to public assistance, national origin, physical or mental disability or sexual orientation
  • Personally identifiable information
  • Comments in favor of or in opposition to political campaigns, elections or related efforts
  • Fraud, spam or content posted by automatic software programs (e.g., “bots”)
  • Advertising, solicitations or promotion of commercial services or products
  • Links to external downloads/websites that are not Town of Oro Valley partners

 

Furthermore, the Town reserves the right to block and/or report users who do not comply with the above guidelines. The Town is not liable for user comments made during livestreams. Users who submit comments to any official Town social media page acknowledge that they have read, understand, and agree to the Town’s terms of use.

NO PURCHASE IS NECESSARY TO BE ELIGIBLE TO WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This contest is open to all Arizona Residents. Town of Oro Valley Employees and immediate family members and/or those living in the same household of employees are not eligible. The contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Only one entry per person, per contest is allowed, all additional entries will be rejected.

2. Agreement to Rules:  By participating, you agree to be fully and unconditionally bound by these rules, and you represent and warrant that you meet all eligibility requirements. You also agree to and abide by the decisions of the Town of Oro Valley as final and binding.

3. Contest Period: Entries will be accepted online starting on date of the Facebook post and ending at the end date and time given. Any entry received outside of the timeframe will be rejected.

4. How to Enter: To enter, submit your entry at http://www.facebook.com/orovalleyazgov. Your entry must meet all eligibility requirements to win a prize, otherwise your entry will be rejected. Any attempt to fraudulently submit any entry will be rejected.

5. Prizes: Prizes will be listed on http://www.facebook.com/orovalleyazgov. No cash or other prize substitution shall be permitted. Prizes are nontransferable. All prize-related expenses, including without limitation to any and all federal, state, and/or local taxes, shall be the sole responsibility of winner. No substitution of prize or transfer/assignment of prize to others is permitted. Acceptance of any prize constitutes permission for the Town of Oro Valley to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation

6. Odds: The odds of winning vary.

7. Winner Selection and Notification: Winner will be selected by a random drawing under the supervision of the Town of Oro Valley. Winner will be notified via Facebook within three (3) days following selection. the Town of Oro Valley shall have no liability for winner’s failure to receive notices for any reason. If winner cannot be contacted, or is otherwise ineligible, fails to claim the prize within [7 days] from the time award notification was posted, or fails to timely return a completed and executed declaration and release as required, the prize shall be forfeited, and an alternate winner selected. Receipt by winner of the prize offered in this contest is subject to compliance with all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT THE TOWN OF ORO VALLEY’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by You: By entering your content (e.g., photo, text, etc.) as part of this contest, you understand and agree that the Town of Oro Valley, anyone acting on behalf of the Town of Oro Valley, and the Town of Oro Valley’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent from you. By entering your content, you represent and warrant that your entry is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless the Town of Oro Valley from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which the Town of Oro Valley may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

9. Terms & Conditions: The Town of Oro Valley reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Town of Oro Valley’s control corrupt or affect the administration, security, fairness, or proper conduct of the contest. The Town of Oro Valley reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the contest or website or violates these Terms & Conditions. The Town of Oro Valley has the right, in its sole discretion, to maintain the integrity of the contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest may be a violation of criminal and civil laws. Should such an attempt be made, the Town of Oro Valley reserves the right to seek damages to the fullest extent permitted by law.

10. Limitation of Liability: By entering, you agree to release and hold harmless the Town of Oro Valley  and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

11. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF ARIZONA. As a condition of participating in this contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Pima County ARIZONA having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses. Participant further waives all rights to have damages multiplied or increased.
