Mayor Winfield issues amendment to emergency proclamation

Oro Valley Mayor Joe Winfield has issued an amendment to Tuesday’s proclamation of a local emergency, with changes that reflect and support decisions made by the Pima County Board of Supervisors at their March 19 special meeting.

“While each community has unique needs, our goal as a region is to bring Pima County into alignment with the management of COVID-19,” said Mayor Joe Winfield. “As this crisis continues to unfold, community leaders are having to constantly reassess current guidelines and determine when to take new measures. Our County Board of Supervisors has determined that this next level of precaution is necessary, so the Town of Oro Valley will follow their lead and adjust our local recommendations accordingly.”

The proclamation amendment includes stricter guidelines for businesses that serve food and beverages. That service will now be restricted to take-out, curb-side or delivery. Consumption of food and beverages is not permitted on the premises. Additionally, certain businesses and gathering places are also ordered closed by Mayor Winfield, including bars, theaters and fitness facilities.

“Many of our restaurants and other businesses have already taken these precautions in an effort to reduce the spread of coronavirus, and we are deeply grateful,” said Winfield. “Please continue working together to identify creative ways to continue supporting local restaurants and businesses.”

Winfield also strongly urges businesses owners, employers, houses of worship and other organizations to limit gatherings on their premises, to establish social distancing practices for their patrons and employees, and to avoid social gatherings of more than 10 people.

These measures will be in effect until March 31, 2020.

AMENDMENT #1 TO TOWN OF ORO VALLEY MAYORAL PROCLAMATION OF EMERGENCY

WHEREAS, on March 17, 2020 Mayor Joseph C. Winfield issued a Mayoral Proclamation of Emergency in response to the actions taken by federal, state, and local jurisdictions in addressing conditions related to the COVID-19 pandemic outbreak; and

WHEREAS, Mayor Joseph C. Winfield has found it necessary under the current circumstances to issue Amendment # 1 to the Town of Oro Valley Mayoral Proclamation of Emergency; and

WHEREAS, all other provisions of the March 17, 2020 Town of Oro Valley Mayoral Proclamation of Emergency not in conflict with this Amendment #1 will remain in force until emergency declared herein abates and is withdrawn; and

NOW, THEREFORE, pursuant to A.R.S. § 26-307 A.R.S. § 26-311, and Oro Valley Town Code 2-1-3, the elements of which are met under the current circumstances and the circumstances described in the March 17, 2020 Town of Oro Valley Mayoral Proclamation of Emergency.

IT IS PROCLAIMED AND ORDERED AS FOLLOWS: 
1. Effective 8:00 p.m. on March 19, 2020 until midnight on March 31, 2020 unless otherwise extended by proclamation, restaurants, cafes, coffeehouses and other similar public food service businesses and establishments located in Oro Valley are hereby prohibited from serving food or beverages for consumption on the premises.
a. Businesses and establishments affected by this section are encouraged to rely on the use of delivery service, curbside-service, or drive-through service, and to use other appropriate precautions so as to mitigate the potential transmission of COVID-19 in serving customers; and
b. In offering food or beverages, a business or establishment that does not have the ability to offer window, drive-thru or drive-up services may permit members of the public on its premises for the purpose of picking up their food or beverage orders; and
c. Members of the public are prohibited from entering said premises and remaining on site to consume food and/or beverages, except as expressly allowed under this section.
d. Hospitals and related care facility necessary food services are exempt.                

2. The following businesses and establishments in Oro Valley are hereby closed to use and occupancy by members of the public beginning 8:00 p.m. on March 19, 2020 to midnight on March 31, 2020 unless extended by proclamation.
a. Bars, taverns, brew pubs, breweries, microbreweries, distilleries, wineries, tasting rooms, special licensees, clubs, and other similar businesses and establishments offering alcoholic beverages or spirituous liquor for consumption on-premises.
b. Theaters, cinemas, bingo halls, museums and indoor and outdoor performance venues and other similar facilities.
c. Gymnasiums, fitness or exercise facilities, recreation facilities, indoor sports facilities, yoga and barre studios, and other similar facilities.

3. All businesses owners and employers, houses of worship and other organizations are strongly urged to limit gatherings on their premises, establish social distancing practices for their patrons and employees, and avoid social gatherings of more than 10 people.

4. These emergency regulations shall remain in full force and effect until such time as the emergency declared herein abates and is withdrawn, or a subsequent Proclamation is issued with amendments.

5. In accordance with ARS 26-307 (B), this proclamation shall be effective when a copy is filed in the office of the Town Clerk. All existing laws and rules in conflict of the same are hereby suspended during the time and to the extent that they conflict.
