You have just received a complaint for a traffic offense and are
unsure of what to do. The court date on your citation is not your
trial date.
You have received a complaint for
a traffic offense and are unsure of what to do.
If you are an adult (18 years of age or older)
and charged with DUI, DRAG RACING, RECKLESS DRIVING, DRIVING ON A
SUSPENDED LICENSE or any other criminal traffic or criminal offense,
you must appear at the court on the appearance date on your
citation and go before a Judge.
If you are a juvenile
(under 18 years of age), regardless of your charge, you
must appear in person on your initial appearance date WITH A PARENT
OR LEGAL GUARDIAN.
If you are an adult (18 years
of age or older) and charged with a civil traffic offense, you
may select one of the following options:
OPTION #1
Plead responsible and pay your fine by mail. Mail the fine
payment following the instructions for PAY THE FINE BY MAIL in this
insert. .Or go to www.townoforovalley.com/court and pay by internet. (A fee may be
assessed by paying online.)
OPTION #2
Plead not responsible and request a hearing by mail. Deny
responsibility and request a hearing by mail by following the
instructions for REQUEST A HEARING BY MAIL in this insert.
OPTION #3
Complete Defensive Driving School BEFORE your court date,
if
you are eligible. Follow instructions for attending the class in
this insert. This will dismiss only one moving violation.
OPTION #4
Appear in court on the date and time indicated on your citation.
FAILURE TO RESPOND on a civil traffic complaint by the
appearance
date will result in a default judgment against you for
the bond/fine amount set out herein, plus a default fee of $70.00.
Your driver license will be suspended by the Motor Vehicle
Division (MVD) until the fine/sanction and fees are paid in full.
FAILURE TO APPEAR by the appearance date on the citation for a
Criminal or Criminal Traffic charge will result in a
warrant being issued
for your arrest.

NOTICE: Per Arizona Revised Statute 12-116, a $20.00 one time
payment will be added to each fine not paid in full on the date that
the Court imposes sanctions.

NOTICE
ARS 28-645A3A, ARS-647
If you are found “Responsible” for a violation of A.R.S. §
28-645A3A, (Failure to stop at a red light), or A.R.S. § 28-647
(Failure to stop for a flashing red light) by either admitting you
are responsible or after a finding by the Court that you are
responsible at a civil traffic hearing, in addition to any
sanctions imposed by the Court, you will be ordered by the Motor
Vehicle Division (MVD) of the Arizona Dept. of Transportation to
successfully complete “traffic survival school training and
educational sessions”. Failure to complete the Traffic Survival
School will result in your driver license or privilege being
suspended by MVD until you complete the Traffic Survival School.
If you are eligible and attend the Defensive Driving School (see
Option #3) and the citation is dismissed, you will not be required
to attend the Traffic Survival School. The Defensive Driving Program
and the Traffic Survival School are NOT the same. If you have
any questions about this, please contact the Motor Vehicle Division
at (520) 629-9808.
Violation of ARS 28-4135A.B.C. (No Mandatory Insurance)
If you had liability insurance on the date cited, mail proof of
insurance to reach the court on or before your court date and
the charge will be dismissed.
If your insurance was not current on the date cited, but you renew
or acquire a minimum of six (6) month insurance policy and submit a
copy to the court, the sanction/fine will be reduced.

If you fail to respond and are
defaulted on charges ARS 28-4135A, B or C:
1st. Offence: $946.00 +
3 months suspension of plate, license and
registration
2nd Offense: $1,390.00
+ 6 months suspension of plate, license, and registration
3rd Offense: $1,850.00
+ 12 months suspension of plate, license and registration
Additional default and late
fess may apply.
You may be eligible for a MVD
issued restricted license if you obtain SR22 Insurance.

IF YOU FAIL TO APPEAR AT THE
COURT AND/OR FAIL TO GET INSURANCE, YOUR LICENSE AND REGISTRATION

If you wish to admit responsibility to the civil traffic charges you
have received, without appearing in court, you may do so by

in full in the envelope provided to the Oro Valley Magistrate Court.

OPTION #2 REQUEST A HEARING
On civil traffic citations only, if you wish to enter a plea
of Not Responsible and have a hearing on the charges in the
complaint, complete the following and mail it to the court at least
(7) days before the appearance date on the citation.
You may post a bond and
enclose the amount from the bond/fine schedule listed in this
insert. If a hearing is requested you will receive a new court date
via mail. If you did not post a bond and fail to appear on
your new court date, Default Judgment will apply and you driver
license will be suspended.

OPTION #3 DEFENSIVE DRIVING SCHOOL (DDS)

Arizona law allows you to resolve one moving civil traffic charge by
attending the DDS.
YOU MUST COMPLETE THE DDS BEFORE YOUR APPEARANCE DATE.
Advantages of attending the DDS:
- The charge will be dismissed.
- No points will be assessed against your driver license.
- You will not have to appear in court on that charge.
- You will not have to pay a fine for that charge.
You may be eligible to attend the DDS if you meet all of the
following conditions:
-Your citation was for a civil moving violation.
-You have not attended a defensive driving class for an Arizona
citation in the last 24 months.
-Your citation was not issued as the result of a collision in which
any person was seriously injured or killed.
-Your case has not been set for a civil traffic hearing.
-You do not have a CDL (Commercial Driver License).

If you wish to attend traffic school in another state, contact
the Arizona phone numbers above. Coordination of the fees and
reporting to the Oro Valley Magistrate Court will be done by the
Arizona National Safety Council.
If you choose the Defensive Driving School, you do not pay the fine
on that one charge.

REPAIRS
If you were cited for any of the following:
28-924A, 28-925A, 28-931C, 28-939, 28-941, 28-952, 28-956,
28-957B or 28-957.01A
Equipment Repair Violations may be resolved one
of three ways:
1: By taking the auto to any
police officer or Sheriff's Deputy and have them verify the repair
by signing the back of your pink citation.
2. By taking or faxing a copy of
the invoice for the repair to the Oro Valley Magistrate Court.
3. Payment of fines/sanction for
the vehicle equipment violation.
The repair must be completed
within seven (7) days of receiving the violation with proof to the
court before your court appearance.
If the repair has been made, the
citation for the equipment violation will be dismissed. If you
fail to have the repair made, the citation will be processed like
any other civil traffic violation.
